Rationale:

Classified as an NHP under Schedule 1 of the Natural Health Products Regulations. NHPs can only contain cannabis parts which either do not meet the definition of cannabis in the Cannabis Act, or that have been exempted from the Cannabis Act through the Industrial Hemp Regulations (IHR). These ingredients are: non-viable seeds or roots of the cannabis plant; mature cannabis stalks without leaves, flowers, seeds, or branches; fibre derived from such a stalk; and hemp derivatives that are compliant with the IHR.

Detail:
The above ingredients must not contain more than 10 parts per million delta-9-Tetrahydrocannabinol (THC), or phytocannabinoids that have been isolated or concentrated. The determination of the THC concentration must take into account the potential to convert delta-9-tetrahydrocannabinolic acid (THCA) to THC. Hemp derivatives must also be compliant with the IHR. All sources of hemp falling under the IHR are expected to be of an approved cultivar, defined in the IHR as any variety of industrial hemp set out in the List of Approved Cultivars, published by the Government of Canada on its website, as amended from time to time.

Rationale:

A non-NHP when the ingredient meets the definition of cannabis in the Cannabis Act: 1. Any part of a cannabis plant, including the phytocannabinoids produced by, or found in, such a plant, regardless of whether that part has been processed or not, other than a part of the plant referred to in Schedule 2; 2. Any substance or mixture of substances that contains or has on it any part of such a plant; and, 3. Any substance that is identical to any phytocannabinoid produced by, or found in, such a plant, regardless of how the substance was obtained. Phytocannabinoids are also listed on the Prescription Drug List as follows: Phytocannabinoids produced by, or found in, the cannabis plant and substances that are duplicates of such phytocannabinoids, except: (a) derivatives of cannabis as defined in subsection 2(1) of the Cannabis Act that are exempt from the application of the Cannabis Act under the Industrial Hemp Regulations and that do not contain an isolated or concentrated phytocannabinoid or a synthetic duplicate of that phytocannabinoid, or (b) anything referred to in Schedule 2 to the Cannabis Act that contains no more than 10 µg/g delta-9-tetrahydrocannabinol and that does not contain an isolated or concentrated phytocannabinoid or a synthetic duplicate of that phytocannabinoid.
